Terms of Use for the Service Life Calculation for Schneeberger MONORAIL Guideways
- A. General
Calculation of the service life for SCHNEEBERGER MONORAIL guideways (henceforth "online tool") offers users (henceforth "user") the chance to calculate the fatigue life for profile rail guideways. This online tool is provided to users by SCHNEEBERGER Holding AG (henceforth "operator"). - B. Entry of personal information and use
Using the online tool for personal use is free of charge. Users are authorized to use and work with the tool without limitations on time or location. The commercial re-utilization of this online tool and individual elements thereof is prohibited. All property rights to this online tool belong exclusively to the operator.
Entry of technical data for the calculation of the fatigue life as well as the entry of personal data pertaining to the user such as his/her true name, the correct company trade name, a verifiable email, and verifiable telephone number are required for the active utilization of the online tool. With the entry of this information and subsequent confirmation, the user indicates his/her agreement to these terms of use. - C. Disclaimer
All information and data contained in the online tool are provided on the basis of the latest technology. The data provided and (if necessary) the assumptions made by the operator form the basis for the calculation of the fatigue life. The results shown in each case take into account the risks that the operator was able to identify based on the data entered by the user.
The operator is not liable for damages of any kind – notably the direct or indirect damages, deficits, or consequential harm caused by defect, losses or costs, that emerge as a result of erroneous or even incorrect use of the online tool by the user. The user utilizes the online tool at his/her own risk.
There is no way to guarantee that the online tool does not contain errors or that errors will not occur from time to time. The operator is, however, constantly endeavoring to keep the online tool functioning properly without errors and to ensure that it is secure. The operator is, therefore, not liable for damages of any kind – notably direct or indirect damages, deficit damages, damages resulting from a deficit, losses or costs, that emerge as a result of the online tool being made available unless these errors were caused intentionally or by gross negligence on the part of the operator. - D. Data protection and use
The operator and companies affiliated with the operator are authorized to use personal information for the purpose of monitoring and internal analysis as long as this information has been explicitly provided on a voluntary basis. This may include data use for the purpose of managing, operating, maintaining, and improving the online tool as well as conveying information when necessary about products and/or services of the operator that may be of interest to individual users. The user explicitly agrees to this. Furthermore, the operator is obligated to keep all personal data strictly confidential and not forward it to third parties. - E. Erasure and retraction
The user may at any time retract his/her past agreement to these terms of use in full or in part for the future by sending an email to the operator (see contact form on the website). When such a retraction is received, all of the user's personal data will be immediately erased. The operator will confirm erasure for the user via email. - F. Maintenance and change
The operator reserves the right to periodically interrupt the operation of the online tool temporarily in order to perform maintenance. The operator will generally announce scheduled maintenance times with advance warning of at least one week. This warning will be posted in an easily visible place on the website. Furthermore, the operator reserves the right to change, supplement, delete, or shut down parts of or the entire online tool, either temporarily or permanently. - G. Place of jurisdiction and applicable law
These terms of use are subject to Swiss law. The sole place of jurisdiction is Berne, Switzerland.
